Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of KrystalView, a software-as-a-service analytics platform operated by Krystal Unity Pty Ltd (“Krystal Unity”, “we”, “us”, “our”).

By creating an account or using the Service you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

No variation or amendment to these Terms is effective unless confirmed by Krystal Unity in writing. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Service Description

KrystalView is a SaaS analytics platform that provides website owners and digital teams with the following capabilities:

• Session replay — record and play back visitor interactions on your website
• Heatmaps — visualise aggregate click, move, and scroll behaviour across pages
• Funnel analytics — track and measure multi-step conversion flows
• Cohort comparison — compare behaviour across visitor segments side by side

We may add, modify, or discontinue features at any time. Where a feature material to your use is discontinued, we will provide reasonable advance notice.

3. Account Responsibilities

• You must provide accurate, current, and complete account and billing information and keep it up to date
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account
• Each account login is for one individual person; shared credentials across multiple users are not permitted
• You must notify us immediately at hello@krystalunity.com if you become aware of any unauthorised access to your account
• You must not create accounts by automated means or under false pretences

4. Billing & Payments

All payments are processed via Stripe. Prices are in Australian dollars (AUD) unless otherwise stated. The following plans are available:

Paid subscriptions renew automatically at the end of each billing period. You may cancel at any time through the console or by emailing us. Upon cancellation, access continues until the end of the current paid billing period. No partial-period refunds are issued unless required by law.

We reserve the right to change pricing with 30 days notice to registered customers. Continued use after the effective date constitutes acceptance of the new pricing.

5. Data Ownership

You own your analytics data. Krystal Unity acts as a data processor, processing your data solely to provide and support the Service on your behalf.

You may export your analytics data at any time through the KrystalView console. We do not claim any intellectual property rights over your data, and we do not use your data for our own commercial purposes beyond delivering the Service.

6. Acceptable Use

You must not use KrystalView to:

• Conduct malicious, deceptive, or unlawful tracking of any individual
• Collect personally identifiable information about visitors without valid end-user consent where required by applicable privacy law
• Resell, sublicense, or otherwise commercialise captured data to third parties without their knowledge
• Attempt to identify individual visitors without their explicit consent
• Interfere with, compromise, or perform security testing against the Service or its infrastructure
• Use the Service for any purpose that violates applicable laws or regulations
• Circumvent any technical limitations, access controls, or usage quotas of the Service

We reserve the right to suspend or terminate accounts that violate these restrictions without notice.

7. Service Availability

We use commercially reasonable efforts to make KrystalView available and reliable. Service availability may be affected by scheduled maintenance, third-party infrastructure dependencies, or events beyond our reasonable control.

Free plans are provided on a best-efforts basis with no service level agreement (SLA) guarantee. Where SLA commitments apply, they will be specified in a separate written agreement with Enterprise customers.

Where possible, scheduled maintenance will be communicated in advance via in-app notice or email.

8. Termination

Either party may terminate this agreement at any time. For paid plans, either party may terminate with 30 days written notice unless a separate enterprise agreement specifies otherwise.

We may suspend or terminate your account immediately without notice if you breach these Terms, fail to pay amounts due, or engage in conduct that poses a risk to us or other customers.

Upon termination, you may request an export of your analytics data for up to 30 days following the termination date. After that period, data will be deleted in accordance with our retention policy.

9. Limitation of Liability

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunity, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law or other applicable legislation, including guarantees of acceptable quality and fitness for purpose.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts.
